Helping you understand rules for private family law children and finance cases from 1 April 2013
Guidance is available to help you understand the new rules on legal aid for children and finance matters in private family law cases from 1 April 2013.
Key changes were made in this area under the Legal Aid, Sentencing and Punishment of Offenders Act 2012
In most of these cases legal aid will only be available where a client has specific evidence in relation to domestic violence or child protection (Paragraphs 12 and 13, Part 1, Schedule 1).
Evidence required
The evidence that is required in order for an application for legal aid to be made in these matters is prescribed in the Civil Legal Aid (Procedure) Regulations 2012 (“the Procedure Regulations”).
- Regulation 33 deals with evidence relating to domestic violence
- Regulation 34 deals with evidence relating to child protection
Guidance is available setting out further detail on information the evidence must contain to satisfy the requirements in the regulations.
