In spite of Alaina Giordano’s claim that the court used her cancer against her in a custody hearing, her children are now going to live with their father.
The North Carolina State Supreme Court denied a request this week for a hold on the order from a lower court giving custody to the father until her appeal of that ruling has been decided. This decision affirms the earlier decision by the state Court of Appeals. The result of this decision is that the two children (ages 11 and 6) will be going to Chicago to live with their father, Kane Snyder. According to the father’s lawyer, Jeffrey Leving (a specialist in father’s rights), the move should happen within a week.
Leving said “We hope the mother will be supportive of the children’s relocation process and not engage in tactics that are designed to influence the children in a negative manner…The children should not be put in the middle of the court process.”
Giordano stated that she is now focusing on her appeal of the custody order made earlier in the year by Durham District Court Judge Nancy Gordon. “In the wake of this legal decision, my children and I now must grieve the pending loss of each other,” her statement included.
Giordano has gained thousands of online supporters across the nation because of her claim that the original custody ruling was based on her Stage 4 breast cancer. Facebook pages and online petitions expressed outrage over the ruling.
Gordon did mention Giordano’s cancer and concerns about her long-term health, but the judge also criticised the conduct of both parents (although she did praise both parents for their love of their children).
Giordano is confident in the treatment she’s receiving in Durham, so she doesn’t want to move to Chicago (even though she would have greater custody rights there), she said, but she does plan to visit her children in Chicago.
